1 The Buyer recognises that the world is currently amidst a pandemic, which may affect how business gets done and cause some difficulty in viewing and collection of assets amongst others.
2 Sellers may have to introduce and modify the rules of engagement relating to the sale and access of various sites. All buyers agree that they will adhere to the regulations and rules set by Government and the Sellers and furthermore agree that the Buyer cannot use this to withdraw from sales.
3 The Buyer recognises that there might be a delay in the collection of assets and/or access to site, which will impact loading time and collection efforts. Each bid that is made by the Buyer is made with this in mind.

  • The assets will be sold “Voetstoots” or “as is where is”. It is the buyer’s responsibility to perform an inspection of the assets prior to the auction.
  • The auction is subject to a reserve price and will not be sold for less than such.
  • The Sale of the assets is non-suspensive and not subject to any feasibility or any other condition required by the buyer.
  • The auctioneer may bid for any lot or lots offered for sale at the Auction on behalf of third parties.
  • The Auctioneer may bid for any lot or lots offered for sale at the Auction on behalf of seller but, if on behalf of the seller, not at or in excess of the reserve price.

3.8.1 Non-ferrous Copper lots: Post collection of the copper, the buyer may not sell the copper to another dealer. Post collection the buyer must sell the copper directly to a local foundry within 1 week of collection being completed. Once sold to a local foundry the buyer is obligated to send the delivery note received from the local foundry to and must include the following:

– Confirmation of the total tonnage sold to them.

– Must include the company details of the local foundry

– Must include identification/description of the lot sold to them Transnet reserves the right to verify that the full tonnage collected from Transnet has been sold directly to a local foundry. Collection of the various grades of copper will be scheduled by Transnet where the buyer of the highest grade collects first, then the buyer of the second grade and lastly the buyer of the low-grade copper (this is to secure the lot in the interest of the buyers.) Buyers MUST adhere to the scheduled removal dates and if unable to collect on the date specific provide an alternative date that falls within 2-3 working days from the suggested date. Buyers need to note that all equipment to process, sort, cut and load the copper needs to be provided by the buyer at their own cost. Tonnages are estimates and will be subject to being weighed to determine the actual tonnage collected. Where there is no Transnet weighbridge within the immediate vicinity, costs of weighing at any other closest facility will be for the buyers’ account. All loads must be weighed with a Transnet representative present and one copy of every weighbridge ticket must be provided to the Transnet representative.
